The process

Six steps, with the handoffs made clear.

The return-to-duty process is individualized. These are the typical stages, not a promised timeline.

Initial SAP evaluation

A comprehensive assessment determines the education and/or treatment appropriate for the individual.

Written recommendations

The SAP prepares recommendations and the required report. There is no standard course or guaranteed timeline.

Education or treatment

The employee completes the assigned recommendations with the appropriate outside provider.

Follow-up evaluation

After completion, the SAP reviews documentation, participation, and successful compliance.

Return-to-duty test

After a favorable SAP determination, the employer ensures the applicable RTD test before safety-sensitive work. A limited FMCSA C/TPA route exists for qualifying drivers without an employer.

Follow-up testing

When safety-sensitive work resumes, the employer implements the SAP’s testing plan.

What a favorable follow-up does not do: It does not itself authorize safety-sensitive work. The applicable RTD test must meet DOT requirements, and the employer makes the employment decision. Read DOT § 40.305 ↗
